Terms and Conditions

Welcome to David Poyant Fine Art (the “Website”). By accessing or using our Website, you agree to be bound by the following Terms and Conditions. Please read them carefully. If you have any questions regarding these terms, please contact the artist for more information.

1. Intellectual Property and Copyright

All content on this Website, including but not limited to images of the artworks, photographs, text, graphics, logos, and the overall design, is the exclusive property of David Poyant and is protected by United States and international copyright laws.

The thread paintings displayed are original, one-of-a-kind works. No prints or reproductions are authorized unless explicitly stated. You may not reproduce, distribute, modify, or publicly display any content from this Website without prior written consent. If you are a member of the press or a gallery seeking to use images for promotional purposes, please contact the artist for more information.

2. Artwork Inquiries and Acquisitions

All artworks listed on the Website are subject to availability. Because each piece is a unique, hand-stitched original requiring dozens to hundreds of hours of labor, availability and pricing are subject to change without notice.

Submitting an inquiry through our Contact or Private Acquisition forms does not constitute a binding purchase agreement. The studio will review your request and reply with availability, pricing, and acquisition details. Regarding shipping, insurance, and handling of fine art, please contact the artist for more information.

3. Private Commissions

David Poyant accepts private commissions on a limited basis. Commissioned works are subject to separate, specific agreements detailing the scope, timeline, deposit, and final pricing. If you are interested in commissioning a custom thread painting, please contact the artist for more information.

4. Studio Visits

The David Poyant studio, located in New Bedford, Massachusetts, is a private workspace. All visits are strictly by private appointment only. We do not accommodate walk-ins. To request a private viewing of available works or a studio tour, please contact the artist for more information.

5. Accuracy of Information

We strive to ensure that all information on the Website—including artwork dimensions, materials (e.g., hand embroidery on canvas or linen), and exhibition history—is accurate, complete, and current. However, we do not warrant that the content is entirely error-free. Colors and textures of the thread paintings may vary depending on your device’s display settings. For detailed condition reports or additional close-up imagery of a specific piece, please contact the artist for more information.

6. Limitation of Liability

In no event shall David Poyant Fine Art be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of, or inability to use, this Website or any information provided herein.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

8. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting to the Website. Your continued use of the Website constitutes your acceptance of the revised terms.
